California Privacy Notice

This notice is for California residents. It is provided under the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act (together, the “CCPA”), and it adds the specific disclosures the CCPA requires to our general Privacy Policy. Where the two differ on California rights, this notice governs.

Read this part first. FinalExpenseChoice is a lead generation website. When you submit a quote request, we pass your information to licensed insurance agents and insurers so they can contact you. Under the CCPA that counts as a “sale” and/or a “share” of personal information — even though no money changes hands for your data specifically — and you have the right to stop it. 1. Categories of personal information we collect

In the past 12 months we may have collected the following, using the CCPA's own category names:

  • Identifiers — name, postal address, ZIP code, email address, telephone number, IP address, and online identifiers.
  • Personal information listed in the California Customer Records statute — name, address, and telephone number.
  • Protected classification characteristics — age and date of birth, and sex or gender, because insurers rate on them.
  • Commercial information — the coverage amount and product type you ask about, and records of quote requests you have made.
  • Internet or other electronic network activity — browser and device type, referring page, pages viewed, and interactions with our calculators.
  • Geolocation data — approximate location from the ZIP code you give us or from your IP address. We do not collect precise geolocation.
  • Sensitive personal information — health information you choose to give us about tobacco use or medical conditions, where you provide it so an agent can tell you which products you may qualify for. See section 3.
  • Inferences — conclusions about the coverage types likely to suit you.

We do not collect Social Security numbers, driver's license or passport numbers, financial account or payment card numbers, biometric information, precise geolocation, contents of your mail or messages, or education records through this Site.

2. Where it comes from, and why we collect it

Sources. Directly from you through our forms and phone calls; automatically from your browser and device as you use the Site; and from advertising and analytics partners and other websites that refer you to us.

Purposes. To connect you with licensed insurance agents who can quote you; to respond to your inquiry; to operate, secure and improve the Site; to measure advertising; to prevent fraud and abuse; and to comply with legal and insurance-regulatory obligations.

3. Sensitive personal information, and your right to limit it

Health information is sensitive personal information under the CCPA. We collect it only where you volunteer it, and we use and disclose it for one purpose: passing it to a licensed agent or insurer so they can tell you what you may qualify for and at what price. We do not use it to infer characteristics about you, and we do not use it for advertising.

You may direct us to limit our use and disclosure of your sensitive personal information to what is necessary to provide the service you asked for. Because passing health details to an agent is the service itself, exercising this right will normally mean we can no longer obtain personalized quotes for you. Request it the same way you would an opt-out, using the contacts in section 7.

4. Who we disclose personal information to

  • Licensed insurance agents, agencies and insurers — so they can contact you with quotes. This is the disclosure that counts as a sale or share.
  • Service providers and contractors — hosting, form processing, telephony, email delivery, and analytics, restricted by contract to those functions.
  • Advertising and analytics partners — limited online identifiers and activity data, which may also count as sharing.
  • Legal and safety recipients — where the law requires it, or to protect rights, safety and property.
  • A successor — in a merger, acquisition or sale of assets, in which case this notice travels with the data.

5. Sale and sharing, stated plainly

In the past 12 months we have sold or shared the following categories: identifiers, California Customer Records information, protected classification characteristics, commercial information, internet activity, geolocation, sensitive personal information you volunteered, and inferences — disclosed to the categories of recipient in section 4 for the purpose of obtaining insurance quotes for you.

We do not knowingly sell or share the personal information of consumers under 16 years of age. Our services are directed to adults.

6. Your California rights

  • Right to know. The categories and the specific pieces of personal information we hold about you, the sources, our purposes, and the categories of third parties we disclosed it to.
  • Right to delete. Deletion of personal information we collected from you, subject to the exceptions the CCPA allows — including records we must keep to satisfy insurance and consumer-protection recordkeeping rules.
  • Right to correct. Correction of inaccurate personal information.
  • Right to opt out of sale or sharing. See section 7. This one is the reason most people are on this page.
  • Right to limit use of sensitive personal information. See section 3.
  • Right to non-discrimination. We will not deny you service, charge a different price, or provide a different quality of service because you exercised a right. We offer no financial incentive in exchange for personal information.

7. How to exercise a right

Two routes, both free:

  • Email [email protected] and say which right you are exercising. For an opt-out, put “Do Not Sell” in the subject line.
  • Call (888) 415-8284 and tell us what you want done.

Include the email address or telephone number you gave us, so we can find your records. Please do not send a Social Security number or financial account details — we do not need them and cannot use them to verify you.

Browser signals. Some browsers and extensions transmit an opt-out preference signal such as Global Privacy Control. We are working toward recognizing those signals automatically. Until we confirm on this page that we do, please use the email or telephone route above so that your request is definitely recorded and actioned — we would rather tell you that than let you assume a signal has been received.

8. Verification, and how long we take

Before acting on a request to know, delete, or correct, we will verify that you are who you say you are by matching the details you give us against our records. If we cannot verify you we will explain why rather than act on an unverified request about someone else's information. An opt-out request does not require verification.

We will confirm receipt within 10 business days and respond substantively within 45 calendar days. If we need more time we will tell you inside that window and may take up to 90 days in total.

9. Authorized agents

Someone else may make a request on your behalf. We will ask for written, signed permission from you, and we may still contact you to confirm it and to verify your identity. An agent holding a valid power of attorney does not need separate written permission.

10. How long we keep information

We retain each category for as long as needed for the purpose it was collected for, and for as long as insurance and consumer-protection recordkeeping rules require us to be able to show what we did and when. After that it is deleted or de-identified. Records of an opt-out request are kept indefinitely, because we need them in order to keep honoring the opt-out.

11. Shine the Light

Separately from the CCPA, California Civil Code section 1798.83 lets a California resident ask once a year for details of personal information a business disclosed to third parties for those parties' own direct marketing. Write to the address in section 7 and we will respond.

12. If you live in another state

Several other states now give residents comparable rights to access, correct, delete, and opt out of targeted advertising or the sale of personal information. If you live in one of them, use the same contacts in section 7 and tell us your state. We will treat your request under whichever law applies to you.
